MANUFACTURER WARRANTY
A. Supplier by default warrants surveillance, security and high-end consumer electronic devices to be free from defects in material and workmanship under normal use and operation for a period of one (1) year after date of shipment to Customer. Supplier’s warranties do not apply to damage resulting from unauthorized use, accident, casualty, alteration, misuse, or failure to follow Supplier’s or Manufacturers’ written instructions. If any model or sample electronic device was shown to the Customer via the ElectroFlip, LLC Website at www.electropflip.com, such model or sample was used merely to illustrate the general type and quality of the devices and not to represent that the devices would necessarily conform to the model or sample in all respects. ENTIRE WARRANTY: SUPPLIER MAKES NO OTHER WARRANTY, EXPRESS OR IMPLIED, AND SUPPLIER EXPRESSLY DISCLAIMS ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE, AND ALL OTHER WARRANTIES ARE HEREBY EXPRESSLY EXCLUDED, SUPPLIER SHALL HAVE NO OTHER LIABILITY, DIRECT OR INDIRECT, OF ANY KIND, INCLUDING LIABLITY FOR SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
B. Customer’s sole and exclusive remedy for breach of the foregoing warranties shall be, at the Supplier’s sole option, the repair of defective electronic parts, the replacement of electronic parts, the replacement of the electronic device, or an electroflip.com store credit; provided (1) the electronic device has not been altered or modified by other than Supplier or Manufacturer, (2) it has been properly stored, maintained and operated with the limits specified by Supplier or Manufacturer, and (3) Customer promptly sends to Supplier notice of defect and satisfactory proof thereof, including allowing Supplier or Manufacturer the opportunity to inspect the electronic device(s), and in the event of repair or replacement, returns the electronic device to Supplier, freight prepaid. Defective parts replaced by the Supplier shall become the property of the Supplier. Repaired parts, replacement parts, and/or replacement electronic device(s) will be shipped to the Customer FOB point of shipment.
C. If the electronic device sold is not manufactured by Supplier, Supplier will extend to the Customer the same warranty protection Supplier received from the original manufacturer.
D. Supplier is not responsible for any warranty work repairs, replacements, or other work or charges relating thereto, that have not been authorized by Supplier in writing.
E. NEITHER SUPPLIER OR CUSTOMER SHALL BE LIABLE TO THE OTHER FOR SPECIAL OR CONSEQUENTIAL DAMAGES OR FOR DAMAGES FOR LOSS OF USE ARISING DIRECTLY OR INDIRECTLY FROM ANY BREACH OF CONTRACT, MATERIAL OR OTHERWISE, OR FROM ANY TORTIOUS ACTS OR OMISSIONS OF THEIR RESPECTIVE EMPLOYEES OR AGENTS, AND IN NO EVENT SHALL THE LIABILITY OF SUPPLIER EXCEED THE PRICE OF THE DEFECTIVE ELECTRONIC DEVICE OR THE ELECTRONIC DEVICE SUBJECT TO LATE DELIVERY.

WARRANTY PLAN PROTECTION

B. The Warranty herein shall be specifically applicable to customers who purchase a Product Warranty Plan from Electroflip, LLC, when completing a purchase of product(s) from www. Electroflip.com. Customer shall have the option of choosing a one (1), two (2) or three (3) year Product Warranty Plan.
C. Replacements may be applicable to the electronic parts internal to the devise, the actual device or an accessory that came with the device. Defective parts replaced by the Supplier shall become the property of the Supplier. Replacement parts, and/or replacement electronic device(s) will be shipped to the Customer FOB point of shipment.
